Interesting topic at the IW Forums, posted by AnonymousDoesNotForgive, regarding 'winnable reasons to get your money back'.

This is going to be long, thorough, and 100% effective, so take your time, grab a drink and read through this carefully. I can tell you this has worked on both sides of the Atlantic and will provide a couple of links for you as well, along with valid, winnable reasons to get your money back. I took a lot of time researching this, consulting a couple lawyer friends of mine, and even spoke with Dan Parsons, head of the BBB in Houston, Texas. If the post gets deleted or my account gets suspended, just chalk it up to the social communism the lurking mods are trying to maintain here. This is for people *who went out and bought a copy from a retailer*, I can not in good conscience say this will work for people who purchased through steam (as someone on another forum brought up, Steam can possibly cancel any other game attached to the same account).

I originally posted this elsewhere since IW's forum system apparently can't remember my original account even though I had it send my username/password to me via e-mail. Some of this may be obvious now, but keep in mind, some people still don't know what they've bought because they haven't given it to their kids yet.

I've been reading the IW forums for weeks now and just wanted to point out a few things :

* No parent, who pre-ordered this game back in August, had or has any clue what happened to this game. For all they know, their kids have been asking for it since the sequel announcement and were given the impression that MW2 was supposed to be a simple sequel to MW. - Now think about this; Some of these parents gave the game to their kids, some are waiting till Christmas. Some of the kids may still be ignorantly anticipating this game, still not knowing what they're about to find (rare, but it could happen). Long story short, a lot of kids and gamers in general are pissed off. A lot of kids who had their parents preorder this game are being yelled at to get their money back because in essence, they didn't get what they wanted. A lot of parents are probably pretty upset.

The boycott isn't working. The dev's are twittering because it's the only thing they can do from their new Droid phones on the beaches of Barbados sipping on Mai-Tai's and laughing it all the way to the bank. The petition signers, myself included went this route in good faith to get the attention of the developers. Clearly that isn't working, as we're being mocked by them, rather than addressed by them.

You wanted to hit IW in their pocketbooks by boycotting the game but it was only a small percentile of the total sales figures due to the console sales.

I run an internet retail company for computer parts and the like so what I'm about to tell you is probably the only feasible solution. I have done this and got my money back, EVEN though the store I purchased it from said "no returns on opened software" so take notice.

This method will not only hit IW's pocketbooks, but will ALSO get your point across to the developers. The developers do not care about the individual, so what you need to do is have the RETAILER do the complaining for you. How do you do this? Simple.

---Do a chargeback on your credit or debit card---

Let me elaborate.

If you file a chargeback, make the reason you're filing it "Defective - product does not work as described."
(i.e. bad lag, hackers, no dedi's, constant d/c's ... finding out IWNet was swapped in without your knowing)

What does this mean? It means you're stuck with a product you can't return because the store won't take it back, however it doesn't WORK the way it was intended to. Your credit card company will return the charge back to you and the place you bought it from will have to EAT the charge. So... now IW doesn't lose their money because the RETAILER bought it from them. YOU bought it from the retailer. If you do a chargeback on your credit or debit card, YOU get your money back; IW got paid by the RETAILER, and the RETAILER gets screwed. Now... how long do you think a place like Game Stop will absorb chargebacks before they SUE Infinity Ward for selling them a defective product?

Exactly. IW won't listen to you, but they WILL listen to their avenues of income; meaning their vendors. If enough retailers jump on and complain and start sueing IW for their losses on chargebacks, IW will HAVE to address THEM, ultimately addressing US.

I handle chargebacks at my store ALL the time for the past 8 years, and let me tell you. EVEN if the retailer wins the first chargeback and they recharge your card, they NEVER win the second one. I can't tell you how many times my shop has been double-chargebacked for the same scam. (When I say scam, people would buy things on my online store, then chargeback immediately, and keep the product. When I explain to the credit card company, the customer never tried a return or has never contacted me, I win the first chargeback, but the dishonest customer does a second chargeback, and no matter what I tell the credit card company, the customer gets their money back and I eat the charge. Great system huh?)

Parent's are going to do this just because their kids will complain that they don't want the game anymore; The game they preordered months before they were 'baited and switched'

That leads me to my other point. Parent's will most likely do chargebacks under the pretense of "Bait and Switch" because they changed it at the last second without notifying ANYONE. How many people do you think Game Stop called after this announcement to warn consumers who preordered and thought they had everything taken care of and only had to worry about picking up their game on delivery day? Exactly... zero. And they have grounds to win their claims. IF they lose that first claim, they can file a second one, and 99.9999999% of the time they win it, so the retailer still loses the money.

Initially it will hurt the retailers, but the retailers will eventually not stand for it and sue IW for compensation if they get enough chargeback losses. My company once sued a company called Inno3d for making really shoddy Nvidia chipset video cards. 99 out of 100 were defective and the chargebacks were endless. We ended up settling out of court with the company for a little over 3 million dollars (we're not a massive company but this was a sizable lawsuit).

If a large retailer or two ends up sueing for compensation, think of the press it would get? Since we, the people can't make a large enough noise, let's let a little negative publicity on the news mediums do it for us. Let's make the retailers use their corporate lawyers to deal with IW's corporate lawyers. Turn them against each other, not user against user; Not gamer against gamer, or platform against platform. This goes beyond this... this is simply bad business and we have the power to put an end to it, or put the world on notice with the proper means.

I'm going to wrap this up since it's getting a bit long in the tooth and I'm certain there's going to be some tl;dr's but for those who held on, I've got one more bomb to drop on IW.

So we've determined two viable reasons for successful chargebacks ( and you got to keep the discs! ) and now, the best one.

FILE a complaint to the Better Business Bureau.

People, you've been lied to, baited, switched and now ignored. All HUGE no-no's in the business world. Again, this is the kind of thing I have to deal with at my company on a daily basis. Remember, keep your complaints respectful when dealing with the BBB.

Oh... and one last thing about the IW forums... all the consolers jumping on the PC forums bashing us for protesting.... remind them to LEARN SOME GAME GENEOLGY. If it weren't for the PC, consoles would have never gotten Call of Duty in the first place. Never settle for less.

Please remember the OFT is not a forum, and is not a group to go into guns blazing. Be an adult about it. Keep your complaint formal, and extremely detailed to better educate them on the situation. These people aren't gamers, so help them help you by better arming them with the facts. The same goes with the BBB.

    Chargeback on credit and Visa debit cards

    What is chargeback?
    Chargeback is a process that allows you to reverse a transaction if you are unhappy with the item received or if your credit or Visa debit card has been used fraudulently.

    Chargeback is not enshrined in law like section 75, but is part of the Visa Scheme Rules, which participating banks subscribe to. It applies to all Visa debit cards, and can also be used for Visa credit card purchases where section 75 is not applicable – for goods costing less than £100 for instance. It also covers prepaid Visa cards and Visa Electron purchases.

    MasterCard operates an equivalent scheme, but this only applies to MasterCard credit card payments, not to purchases made with a Maestro debit card. American Express does not offer a chargeback scheme.

    When can chargeback be used?
    Like section 75, chargeback can be used in cases of goods not arriving, arriving damaged, arriving not as described, or where the merchant has ceased trading.

    Claims must be addressed to the bank that provides your Visa debit card or your credit card, which in turn will put in a request to the merchant’s bank. As a result, you should still get your money back from the merchant's bank, even if the merchant has ceased to trade.

    Conditions and requirements of chargeback
    The main requirement for compensation is evidence that there has been a breach of contract.

    There is also a 120-day time limit on claims. This time limit starts from the day you are aware of a problem. In the case of tangible goods that you've purchased from a shop or online it would therefore be from the day you receive the items. In the case of something like flights, with an airline that goes out of business for example, it would be from the day the flight was due to depart.

    Chargeback troubleshooting
    If you have any trouble when putting in a claim to your credit or Visa debit card provider, try asking to speak to a supervisor. Chargeback is less well-known than section 75, and some bank staff may not be aware of this rule.

    If your card provider rejects your chargeback claim, you can take your case to the Financial Ombudsman Service within six months of your final correspondence.

    PayPal and chargeback
    Although payments made through online payment systems such as PayPal are not covered by section 75, they should be covered by the chargeback rules, so it's worth putting in a claim.

    When you make a purchase using PayPal, your PayPal account usually takes a corresponding amount from your current account to pay for it, making it easy to track the link between a purchase and its associated payment.

    However, if you tend to keep cash in your PayPal account (for example if you've sold an item recently), PayPal will use this money to pay for new purchases, rather than taking it from your bank account. This could make it more difficult to establish the link between the purchase and the payment, although it's still worth putting in a claim, for example if you've missed the eBay and PayPal complaint deadlines or you're not happy with the outcome.

    Thats what I fear will happen. I'm tired of all these console ports, now days the only way to get a non-console ported game is to get a PC exclusive/prioritized game. Like L4D2 for Prioritized or STALKER for exclusive.

    Games are getting so over simplified now, its insulting to anyones intelligence. They assume every gamer is a 12yr old idiot; though a lot of consol gamers are. However, when i started playing video games, i didnt have a console.

    So when I was 9, while my friends were playing NES, i was trying to get half-life running on my old rig. And i can tell you this; having to spend so much time tweaking my computer to get it to run my games, has been a great learning experience.

    Computer gaming is what got me involved in the computer science field. Console gaming on the other hand, dumbs people down.

    They kill pc gaming and suddenly the whole World is going console? The only reason pirating does not happen to the same extent is that modding console is a scary process for the kids and they might get banned but I can assure you the piracy is happening on consoles and will only get worse. As for why piracy happens? SHIT GAMES, I have been fucked for so many years buying legitimate copies of games that were absolute shit and unplayeable, some were fixed by patches but most just died, MOH Airborne, WAW were totally unplayeable on release so my view has now changed. I download torrent check the game out and if I like it I go and buy original. Armed with fistful of $$ I go to my retailer looking for a game and there is nothing on the shelves worth buying NOTHING!
    Why did IW decide to make these changes to an already existing title? Why not introduce a totally NEW game and try this IWNET/STEAM shit? WHY? They wanted to ride on the success of the cod series yet deliver a total piece of SHIT, that is my complaint, if this change is so positive blah blah why not deliver it on new game? The question I ask is who the fuck would have bought this game if it was something new ie not COD? So if you are going to use the franchise to make sales you should stay true to the game not make a bunch of nonsensical and downright retarded changes that only anger your customers. PC gamers have every right to complain, IW released a PC version therefore PC gamers are customers, if you dont release for PC ie cod3 then fine but if you release for PC then it should be a PC game not some fucking shit console port, and I am entitled as a CUSTOMER to complain if product is shit. The attitude of IW/Activision to their customers is downright rude and I am certain this will come back to FUCK THEM UP! In the meantime you enjoy you D$L$C$, playing by yourself and the other bunch of fucking retards that actually support these assholes.

    Seriously? This is your response to console owners?
    How about their response that if YOU hadn't fucked up developers business model in the first place with the continued hacking, cracking and sharing of software we'd ALL still be playing on dedicated servers with proper customer support, and developer supported Mod communities.

    As an ex-PC gamer I know what I'm talking about when I say the PC gaming fans have reaped what they've sown.

    PC's are mode difficult to develop for, harder to provide technical support for, more demanding and less profitable than consoles now.

    The good news is that this recent MW2 nonsense has shown PC owners to be exactly the same type of rabid fanboys that you find in any console forum too.

    Personally I think you're all pathetic.

    Do you honestly believe that nonsense you're spouting off? It's because of the modding community that the Call of Duty line of games is where it is today. If you weren't such a guns-blazing pillock you would know that "geneology" is and would realize that it's because of the hard working modders that made this series so long-lasting in the first place. It's the flexibility of dedicated servers and mod tools that allowed the game to thrive in the competitive community and be tournament worthy.

    Perhaps you should do some research on the complete farse of the first MW2 tournament that was slated to be held in the UK and how it was cancelled because the current IW system is deemed unusable. Perhaps you should speak to the hundreds of thousands of people that comment and listen to BashAndSlash webcasts about the game and it's shortcomings and complete breakdown of the community and competitive/tournament usability in general. Perhaps you should remember that Activision and Infinity Ward are a business, and being a business, are entitled to hold some integrity and honesty towards their avenues of income (i.e. the retailers and ultimately the consumer).

    Perhaps you've forgotten that there are still thousands of copies under children's christmas trees from casual players that don't read forums and have no idea of the "bait and switch" they've fallen victim to; Thousands of copies sold already which made the games sales figures look good.

    Let's get into those sales figures. Perhaps you've forgotten that the sales figures were so astronomically high in the first place all in part to the reputation of the game that came before it (CoD4) and it's enormous success on both console and PC.

    And finally... Perhaps YOU sir, have forgotten, that WE, the hardcore and competitive community were once the "casual gamer" and that with time, patience and skill, we've grown into the gamer we are today. Clearly you have forgotten where we came from in the first place.
